Below are notices pursuant to the California Consumer Privacy Act (as amended by the California Privacy Right Act) and other applicable US state consumer data privacy and protection legislation. These notices may be updated by us at any time by posting and updating the “last updated” date appearing at the end of these notices. Any updates will be effective once posted on this website. Please see below for the rights available to California consumers who are California residents under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, “CCPA”) (available at this link: CCPA). Please note that although the CCPA provides that a California consumer may make certain requests, we may decline the request as permitted by law.

California consumers who are residents of California may request to exercise to the rights below by submitting a verifiable request that specifies the applicable right via either our toll-free number at 1-833-705-0542 or via this email: [email protected].

Please note that California consumers who are California residents making a request to exercise the rights below may be required to verify their identity.

RIGHT TO REQUEST TO KNOW/ACCESS

California consumers who are California residents have the right to know what categories of personal information (as defined in the CCPA) we collect, the categories of sources from which we collect personal information, the business or commercial purpose for collecting, selling or sharing personal information, the categories of third parties to whom we disclose personal information, and the right to access such specific personal information we have collected about such consumer. For more information about the categories of personal information that we collect, our sources, our business or commercial purposes for collecting, selling or sharing personal information and the categories of third parties to whom we disclose it, please see our Privacy Statement available at this link: Privacy Statement.

RIGHT TO REQUEST DELETION

California consumers who are California residents have the right to request that we delete all or a portion of their personal information collected from the consumer. If we are unable to verify the California consumers who are California resident’s identity, we shall treat the request as a Request to Opt-Out.

RIGHT TO REQUEST NOT TO SELL

California consumers who are California residents have the right to opt-out of the sale of their personal information by us.

Please note that as we understand the term “sell” as used in the CCPA, we do not “sell” your personal information, nor have we “sold” your personal information in the past twelve months.

RIGHT TO REQUEST NOT TO SHARE

California consumers who are California residents have the right to opt-out of the sharing of their personal information by us.

Like a number of other companies, we use services provided by (and “share” (as the term is used in the CCPA) your personal information with) Google and others that may deliver ads to you as described in our Privacy Statement available at this link: Privacy Statement. Please see the Cookie Settings page on the applicable Site for more information about cookies we use and how to manage your preferences.

RIGHT TO REQUEST CORRECTION

California consumers who are California residents have the right to request that we correct personal information maintained by us about them that is inaccurate, taking into account the nature of the personal information and the purposes of the processing of the personal information.

RIGHT TO LIMIT USE OF SENSITIVE PERSONAL INFORMATION

California consumers who are California residents have the right to request that we limit our use of sensitive personal data to that use which is necessary to perform our services or provide our goods reasonably expected by an average consumer who requests such services or goods. Sensitive personal information that is collected and processed without the purpose of inferring characteristics about a consumer is not subject to this right. We may collect sensitive personal information (as the term is used in the CCPA) as described in our Privacy Statement available at this link: Privacy Statement. However, we do not use sensitive personal information for the purposes of inferring characteristics about you.

NON-DISCRIMINATION AND NON-RETALIATION/FINANCIAL INCENTIVES

We will not discriminate or retaliate against California consumers who are California residents for exercising the privacy rights conferred by the CCPA, including consumers who are job applicants, employees, or independent contractors. In the event you exercise your rights under the CCPA, unless permitted by the CCPA, we will not: (i) deny you goods or services, (ii) charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties, (iii) provide you a different level or quality of goods or services or (iv) suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by the CCPA that may result in different prices, rates or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects.

Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.

AUTHORIZED AGENT

California consumers who are California residents may designate an authorized agent to make a request under the CCPA or this policy on the California consumers who are California resident’s behalf, provided that the California consumers who are California resident provides proof of their written authorization designating an agent to us.

  • Rhode Island consumers who are Rhode Island residents under the Rhode Island Data Transparency and Privacy Protection Act (“RIDTPPA”) (available at this link: RIDTPPA).

The above listed acts are referred to in this Notice, individually and collectively, as the context requires, as the “US State Data Privacy Law(s)”. The above listed states are referred to in this Notice, individually and collectively, as the context requires, as the “Applicable State(s)”. Please note that although the US State Data Privacy Law(s) may provide that consumers who are residents of the Applicable State(s) may make certain requests, we may decline the request as permitted by law.

Consumers who are residents of an Applicable State may request to exercise the rights below by submitting a verifiable request that specifies the applicable right via either our toll-free number at 1-833-705-0542 or via this email: [email protected].

A consumer who is a resident of an Applicable State making a request to exercise the rights below may be required to verify such consumer’s identity.

RIGHT TO REQUEST CONFIRMATION AND ACCESS

A consumer who is a resident of an Applicable State has the right under the US State Data Privacy Law applicable to such consumer to request confirmation that we process (i.e., collect, use, store, disclose, analyze, delete or modify) such consumer’s personal data (as defined in such US State Data Privacy Law) and to access such personal data.

For consumers who are residents of Connecticut, the right to request confirmation includes confirmation as to whether we process such consumer’s data for the purpose of profiling to make a decision that produces any legal or similarly significant effect concerning such consumer, and the right to access also includes access to any inferences about such consumer derived from their personal data.

RIGHT TO REQUEST CORRECTION

A consumer who is a resident of an Applicable State (with the exception of Iowa) has the right under the US State Data Privacy Law applicable to such consumer to request that we correct inaccuracies in such consumer’s personal data, taking into account the nature of the data and purposes of processing.

RIGHT TO REQUEST DELETION

A consumer who is a resident of an Applicable State has the right under the US State Data Privacy Law applicable to such consumer to request that we delete personal data provided by or obtained about such consumer (in the case of consumers who are residents of Utah and Iowa, this right only applies to personal data provided to us by such consumer).

RIGHT TO REQUEST TO OBTAIN A COPY

A consumer who is a resident of an Applicable State has the right under the US State Data Privacy Law applicable to such consumer to request to obtain a copy of certain consumer’s personal data (subject to certain limitations set forth in the applicable US State Data Privacy Law, including as set forth below) in a portable, and, to the extent technically feasible, readily usable format.

In the case of consumers who are residents of Connecticut, Delaware, Maryland, New Hampshire, and Rhode Island, this right is limited to personal data processed by automated means. In the case of consumers who are residents of Texas, this right is limited to personal data provided by the consumer making the request to exercise the right to obtain a copy and which is available in a digital format.

In the case of consumers who are residents of Indiana, Iowa, Kentucky, Minnesota, Montana, Tennessee, Utah and Virginia, this right is limited to personal data which is processed by automated means and which was provided by the consumer making the request to exercise the right to obtain a copy.

In the case of consumers who are residents of Nebraska, this right is limited to personal data which is available in a digital format, which is processed by automated means, and which was provided by the consumer making the request to exercise the right to obtain a copy.

In the case of consumers who are residents of Indiana, we may, in our discretion and taking into account the nature of the personal data and the purposes of processing, provide a representative summary in place of a copy of such personal data.

Additionally, consumers who are residents of Colorado may only make the request to exercise this right twice per calendar year, and consumers who are residents of Indiana may only make the request to exercise this right once per twelve-month period.

RIGHT TO REQUEST TO OBTAIN A LIST OF THIRD PARTIES

A consumer who is a resident of Oregon, Delaware, Minnesota or Maryland has the right under the US State Data Privacy Law applicable to such consumer to request to obtain a list of third parties or categories of third parties to which we have disclosed such consumer’s personal data or any personal data (subject to certain limitations set forth in the applicable US State Data Privacy Law, including as set forth below).

In the case of consumers who are residents of Oregon, such list is not required to include natural persons, and we may, at our option, instead provide a list of specific third parties to which we have disclosed any consumer’s personal data.

In the case of consumers who are residents of Connecticut, Delaware or Minnesota, we may provide a list of specific third parties to which we have disclosed any consumer’s personal data if we do not maintain a list of specific third parties to which we have disclosed the requesting consumer’s personal data.

In the case of consumers who are residents of Maryland this right is limited to obtain a copy of the categories of third parties to which we have disclosed the requesting consumer’s personal data, and if we do not maintain such list, we may provide a list of the categories of third parties to which we have disclosed any consumer’s data.

RIGHT TO REQUEST DISCLOSURE OF CATEGORIES OF PERSONAL DATA AND THIRD PARTIES

A consumer who is a resident of Tennessee has the right under the TIPA to request disclosure of the categories of personal data about such consumer that we have sold or disclosed for a business purpose, the categories of third parties to which we have sold or disclosed for a business purpose such categories of personal data.

RIGHT TO REQUEST TO OPT-OUT

A consumer who is a resident of an Applicable State has the right to opt out of targeted advertising and the sale of personal data. Please note that as we understand the term “sell” as it’s used in the US State Data Privacy Laws, we do not “sell” your personal data.

Consumers who are residents of Colorado, Kentucky, New Jersey, Oregon and Virginia have the right to opt out of profiling in furtherance of decisions that produce legal or similarly significant effects.

Consumers who are residents of Connecticut or Minnesota have the right to opt out of profiling in furtherance of automated decisions that produce legal or similarly significant effects.

Consumers who are residents of Delaware, Maryland, Montana, New Hampshire or Rhode Island have the right to opt out of profiling in furtherance of solely automated decisions that produce legal or similarly significant effects.

Consumers who are residents of Indiana, Nebraska and Texas have the right to opt out of profiling in furtherance of decisions that produce legal or similarly significant effects, where “profiling” means solely automated processing of personal data to evaluate, analyze, or predict personal aspects concerning such consumer.

RIGHT TO CONTEST PROFILING

Consumers who are residents of Connecticut or Minnesota have the right, if feasible, to question the result of any profiling in furtherance of any automated decision that produced any legal or similarly significant effect concerning such consumer, to be informed of the reason that such profiling resulted in such decision, to review such consumer’s personal data that was processed for such profiling. If such profiling decision concerned housing, consumers who are residents of Connecticut or Minnesota have the right, taking into account the nature of the personal data and the purposes for which such personal data was processed, to correct any incorrect personal data that was processed for the purposes of such profiling and have the profiling decision reevaluated based on the corrected personal data.

In the event we decline your request under the applicable US State Data Privacy Law, you may appeal our decision by calling our toll-free number at 1-833-705-0542 or via this email: [email protected]. Please provide your state of residence and any documentation you may have regarding the matter you are appealing (e.g., a copy of your request and a copy of our response).

We will not discriminate against consumers who are residents of the Applicable State(s) for exercising the privacy rights conferred by the US State Data Privacy Law(s) applicable to such consumers. In the event you exercise your rights under the US State Data Privacy Law applicable to you, unless permitted by such law, we will not: (i) deny you goods or services, (ii) charge you different prices or rates for goods or services, or (iii) provide you a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by the US State Data Privacy Law applicable to you that may result in different prices, rates, levels, quality or selection of goods and services.
